Our client’s Corvette was left totaled while they were trapped and bleeding inside after another driver ran a red light and T-boned our client’s vehicle. Emergency personnel were able to extract our client from their car by removing the door and rushed them to Wellstar Kennestone Hospital.
Our client was treated for multiple injuries sustained in the accident including:

- Neurogenic bladder secondary to motor vehicle accident

- Elbow surgery lateral and medial epicondylitis
- Contusions
- Concussion
- Lab belt injury
Once released to a doctor’s care, our client reached out to our firm and we soon filed a lawsuit. State Farm agreed to mediate within 90 days but reneged the night before the mediation was due to begin.
We proceeded to fight State Farm for three years, including contesting an expert brought in by State Farm who alleged the incontinence suffered by our client was not a result of the accident. We were later able to cross-examine the expert who finally admitted that the accident may have in fact caused the incontinence.
Our firm further noticed four witness and five medical depositions and beat State Farm’s Motion for Summary Judgment. State Farm finally agreed to a settlement in January 2015, almost three years after the accident. Mr. Kalka remarked that though it was an uphill battle, in the end, it was worth the fight.
