At The Kalka Law Group, we are commonly asked questions about seeking compensation for Uber and Lyft accidents. And while financial responsibility for an accident will generally fall to the insurance company of the at-fault driver, which particular insurance policy applies can be complicated when it comes to rideshare accidents. Here are answers to three frequently asked questions regarding Uber and Lyft accidents:
Question #1: Whose Policy Applies?
If you are the passenger in a rideshare vehicle, then the driver’s car insurance coverage should apply to your accident injuries, as long as the driver has a commercial insurance policy or a personal car insurance policy with a special provision authorizing use of the vehicle for rideshare driving. However, rideshare drivers don’t always carry these forms of insurance or might have a “business use exception” that doesn’t cover damages arising from for-profit driving
Both Uber and Lyft carry third party liability insurance coverage which pays up to $1 million for personal injuries and property damage for accidents involving their drivers and passengers. These policies only apply though when the rideshare driver’s personal insurance is exhausted. Passengers are covered under the $1 million policy if the rideshare driver is at-fault for the accident.
Question #3: What If the At-Fault Driver is Uninsured/Underinsured?
Rideshare companies like Uber and Lyft also have uninsured/underinsured (UM/UIM) insurance coverage worth $1 million per accident. UM/UIM policies only apply when the identity of the at-fault driver is unknown, the at-fault doesn’t have insurance, or the at-fault doesn’t enough insurance to cover your injuries. This policy only applies from the time the when rideshare driver picks up the passenger and drops them off.
